INTRODUCTION
Lab RooTC LLC Terms and Conditions:
ORDER TERMS AND CONDITIONS
These Terms and Conditions apply to all hemp-related orders and all orders placed with Lab RooTC LLC (“Lab RooTC”). By placing an order, the customer agrees to the following:
1. Compliance with Laws
All hemp products/products sold by Lab RooTC are intended to comply with applicable federal and state laws, including the 2018 Farm Bill and relevant state regulations. It is the customer’s sole responsibility to ensure that the purchase, transport, and use of hemp products is legal in their jurisdiction.
Lab RooTC is not responsible for any regulatory issues, seizures, or legal consequences resulting from shipment into restricted or non-compliant areas.
2. THC Compliance
All hemp products are produced in compliance with federal law and are intended to contain no more than 0.3% delta-9 THC on a dry weight basis at the time of testing. Lab RooTC provides documentation where applicable; however, the customer assumes all responsibility for compliance after receipt, including cultivation, handling, transport, and use.
Lab RooTC shall not be liable for any changes in THC levels due to environmental conditions, cultivation practices, or post-delivery handling.
3. Order Acceptance
All orders are subject to acceptance by Lab RooTC. Lab RooTC reserves the right to refuse or cancel any order due to availability, compliance concerns, licensing requirements, or delivery limitations.
4. Licensing and Documentation
Customers may be required to provide valid licenses, permits, or documentation prior to order fulfillment. Lab RooTC reserves the right to request and verify such documentation at any time.
5. Pricing
All pricing is subject to change without notice. Orders will be invoiced at the price in effect at the time of order confirmation. Wholesale pricing applies to qualified customers only.
6. Shipping and Risk of Loss
All shipments are made at the customer’s risk. Lab RooTC may assist in arranging transportation; however, once products leave Lab RooTC’s facility, Lab RooTC assumes no liability for loss, delay, damage, or seizure.
Carrier liability is limited. Customers must:
Inspect shipments upon delivery
Note any damage or discrepancies on the Bill of Lading (BOL)
Provide photographic documentation immediately
Failure to document issues at delivery may result in denial of claims.
7. Live Plant Material Disclaimer
Hemp plants are living products and are subject to variability due to environmental conditions, handling, and care after shipment. Lab RooTC does not guarantee plant performance, cannabinoid expression, or yield after delivery.
All sales of live plant material are final.
8. Returns and Credits
Returns are not accepted without prior written authorization. Any approved claims must be submitted within [24–48 hours] of delivery with supporting documentation.
Credits, if issued, will be applied at Lab RooTC’s discretion and may be limited to replacement product or account credit.
9. Payment Terms
All invoices are due in accordance with agreed payment terms. Late payments may result in order delays, suspension of service, or additional fees.
10. Indemnification
Customer agrees to indemnify, defend, and hold harmless Lab RooTC, its owners, officers, employees, and affiliates from and against any and all claims, damages, losses, liabilities, costs, or expenses (including attorneys’ fees) arising out of or related to:
Customer’s use, cultivation, resale, or distribution of products
Any violation of applicable laws or regulations by the customer
Any failure to maintain compliance with hemp-related laws post-delivery
11. Limitation of Liability
To the fullest extent permitted by law, Lab RooTC shall not be liable for any indirect, incidental, or consequential damages, including but not limited to crop loss, lost profits, or regulatory penalties.
Lab RooTC’s total liability shall not exceed the purchase price of the product.
12. Force Majeure
Lab RooTC shall not be liable for failure or delay in performance due to events beyond its control, including but not limited to weather, transportation delays, regulatory changes, or acts of God.
13. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes shall be resolved in the appropriate courts located within the State of Florida.
14. Entire Agreement
These Terms and Conditions constitute the entire agreement between Lab RooTC and the customer.
